This case highlights a serious prosecution for Aster Healthcare, their care manager and a carer.
The company was prosecuted under the Corporate Manslaughter & Corporate Homicide Act and received a fine of over £1.04 million following the death of a resident due to scalding following damming evidence that senior management were aware of issues with the TMV devices on their hot water taps but did not address the problem.
The home manager AND a carer were also prosecuted and and were sentenced to imprisonment, suspended for 18 months.
The company also received a Publicity Order under the Corporate Manslaughter and Corporate Homicide Act which has forced them to pay for an advert in trade journals ‘Health Service Journal’ and the ‘Nursing Times, as well as to put a notification on their company website about what they had done.
